Terms governing your use of the Claims Doctor website and telehealth services.

1. Services

Claims Doctor provides telehealth medical consultations for patients with active WorkCover (workers compensation) or CTP (Compulsory Third Party) claims in New South Wales. Our services include clinical assessments, issuing Certificates of Capacity and Certificates of Fitness, return-to-work planning, and referrals to specialists and allied health providers.

2. Eligibility

To use Claims Doctor services, you must have an active WorkCover or CTP claim in NSW with a valid claim number. You must be located in New South Wales at the time of your consultation. You must have access to a device with a camera, microphone, and internet connection suitable for a video consultation.

3. Telehealth Consent

By booking and attending a telehealth consultation with Claims Doctor, you consent to receiving medical services via video consultation. You acknowledge that telehealth has inherent limitations compared to in-person consultations, including the inability to perform a physical examination. Your doctor will assess whether telehealth is clinically appropriate for your presentation and may recommend an in-person consultation if required.

4. Medical Services Disclaimer

Claims Doctor provides medical assessments and documentation for WorkCover and CTP claims. We do not provide legal advice, claims management services, or guarantee any claim outcomes. The issuance of a certificate reflects a clinical assessment of your condition and capacity — it does not determine the outcome of your compensation claim.

5. Cost and Billing

There is no out-of-pocket cost to you with a valid, active WorkCover or CTP claim number. Claims Doctor bills your insurer directly at SIRA-gazetted rates (WorkCover) or AMA rates (CTP). If your claim number is invalid, expired, or your insurer does not accept the billing, you may be liable for the consultation fee. We will advise you of this before proceeding.

6. Cancellation and No-Shows

If you need to cancel or reschedule your appointment, please do so at least 2 hours before your scheduled time. Repeated no-shows may result in restricted access to same-day bookings.

7. Accuracy of Information

You are responsible for providing accurate information about your identity, claim details, injury, and medical history. Providing false or misleading information may constitute fraud and will be reported to the relevant insurer and authorities.

8. Intellectual Property

All content on the Claims Doctor website, including text, images, logos, and design elements, is the property of Health Data Research Pty Ltd and is protected by Australian intellectual property laws. You may not reproduce, distribute, or use our content without written permission.

9. Website Use

The information on the Claims Doctor website is provided for general informational purposes and does not constitute medical advice. Always consult a qualified medical practitioner for advice specific to your situation. We make reasonable efforts to keep the information current and accurate, but do not guarantee that all content is complete or error-free at all times.

10. Limitation of Liability

To the maximum extent permitted by law, Claims Doctor (Health Data Research Pty Ltd) is not liable for any indirect, incidental, or consequential damages arising from your use of our services or website. Our liability for any claim arising from our medical services is limited to the fees charged for the relevant consultation. Nothing in these terms excludes or limits any consumer guarantees under the Australian Consumer Law that cannot be excluded.

11. Governing Law

These terms are governed by the laws of New South Wales, Australia. Any disputes are subject to the jurisdiction of the courts of New South Wales.
