What Is a CTP Claim?
Compulsory Third Party (CTP) insurance is a statutory scheme that provides benefits to people injured in motor vehicle accidents in NSW. It is regulated by SIRA under the Motor Accident Injuries Act 2017. CTP insurance is included in your vehicle registration (green slip) and covers all road users — drivers, passengers, pedestrians, and cyclists.
Approximately 12,000 motor accident injury claims are filed annually in NSW, with $1.5 billion paid out in benefits and lump sums.
Who Is Eligible?
Any person injured in a motor vehicle accident in NSW is eligible for CTP statutory benefits, regardless of who was at fault. This includes drivers, passengers, pedestrians, cyclists, and motorcyclists. Benefits are available from the CTP insurer of the at-fault vehicle, or from the insurer of the vehicle in which the injured person was travelling.
How to Lodge a Claim
To lodge a CTP claim, you must notify the relevant CTP insurer within 28 days of the accident. The insurer is the CTP provider of the at-fault driver's vehicle. You can identify the insurer using the SIRA CTP insurer lookup tool or by checking the vehicle's green slip. You will need the vehicle registration number, date and location of the accident, and a police event number if police attended.
Your Entitlements
CTP statutory benefits include weekly payments to replace lost income, medical treatment and rehabilitation expenses, domestic assistance, and attendant care for severe injuries. If another party was at fault, you may also be entitled to lump sum compensation for pain and suffering (non-economic loss) and economic loss.
Certificate of Fitness
The Certificate of Fitness is the CTP equivalent of the WorkCover Certificate of Capacity. It documents your injuries, capacity for work, and treatment recommendations.
